Recently I was asked If I have a prior wet and reckless from 2014, was just arrested for a DUI will this count as a second or a first. A wet and reckless is lawyer talk for vehicel code 23103.5 and in essense it's driving with alcohol in your system, it's not up to the level of driving under the influence or impaired as a DUI, but in a reckless manner. If you get a subsequent or later DUI that wet and reckless then morphs itself to a priorable offense. That means that this wet and reckless will be treated as if is a DUI and any subsequent DUI after that fact will be a second of third depending on your fact pattern. Hope that answers your question.
