Arrested for a dui while changing my flat tire?

Q. I hit a pothole of it gave me a flat. I was in the middle of changing my tire when chp pulls up behind me. He smelt alcohol gave me a FST and then arrested me. He didn’t see me driving, is that enough for a dui charge?!

A. Unfortunately it is they can prove you're driving through the circumstantial evidence and very often they get you to admit your driving. He will have to be able to prove when you pulled over there to change the flat tire. Usually they’re smart enough to ask you if you were driving and confirm when you pulled over. Either way you’re going to need an attorney good luck. It's not bad idea however to
talk to an attorney and get a consultation to see if there is some way of getting you out of it.
